A neighbour alerted authorities after hearing loud screams coming from the former CSI: Crime Scene Investigation star's home in Venice, California last month (Mar10) .
Upon arrival at the actor's address, cops noticed a scratch on Dourdan's neck and arrested his girlfriend, Maria Asis del Alamo, on a misdemeanour battery charge.
But TMZ.com reports the criminal case against the Spaniard was dismissed on Tuesday (06Apr10) after prosecutors conceded the couple were not fighting but instead enjoying a heated bedroom session.
